Welcome to PetMasterpiece. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account or using any part of our service, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you may not use our services.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account and to keep it up to date. You are responsible for all activity that occurs under your account.

You must be at least 13 years of age to use our services. If you are under 18, you must have a parent or guardian's permission to use our platform.

3. AI-Generated Artwork

Ownership

You retain ownership of any pet photos you upload. The AI-generated artwork created from your photos is yours to use, download, share, and display for personal and commercial purposes.

Usage Rights

By uploading a photo, you grant PetMasterpiece a limited license to process the image through our AI pipeline for the purpose of generating your artwork and creating product mockups. We will not use your photos or generated artwork for any other purpose without your consent.

AI Limitations

AI-generated artwork is created using machine learning models and results may vary. While we strive for high-quality output, we cannot guarantee exact likeness or specific artistic outcomes. Each generation produces unique results.

4. Product Purchases

Pricing

All prices are displayed in US dollars and include the base product cost. Shipping costs are calculated at checkout based on your delivery address and selected shipping method. We reserve the right to update pricing at any time; however, orders already placed will be honored at the price shown at checkout.

Shipping

Products are manufactured and shipped by our fulfillment partner, Printful. Shipping times vary by product type and destination. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control.

Returns and Refunds

Due to the custom, made-to-order nature of our products, we generally do not accept returns for buyer's remorse or style preference. However, if your order arrives damaged, defective, or significantly different from what was shown, please see our Satisfaction Guarantee for replacement and refund options.

5. Prohibited Uses

You agree not to:

  • Upload content that you do not have the right to use.
  • Upload content that is offensive, harmful, or violates any applicable law.
  • Use the service to generate content depicting anything other than pets or animals (the service is designed specifically for pet artwork).
  • Attempt to reverse-engineer, decompile, or access the underlying AI models or proprietary systems.
  • Use automated tools (bots, scrapers) to access the service without prior written permission.
  • Resell access to our platform or AI generation capabilities.

6. Intellectual Property

The PetMasterpiece name, logo, website design, and all related branding are our intellectual property. Our AI art styles, prompt engineering, and pipeline architecture are proprietary. You may not copy, reproduce, or distribute any part of our platform without permission.

7. Limitation of Liability

To the maximum extent permitted by law, PetMasterpiece shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, revenue, or profits.

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated results will meet your expectations.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct that we determine is harmful to other users or our business. You may also delete your account at any time by contacting support.

Upon termination, your right to use the service ceases immediately. Any pending orders will be fulfilled. Your uploaded photos and generated artwork may be deleted within 30 days of account termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of the applicable jurisdiction within the United States.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through our website or via email. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
